Defense Appropriations

On December 18, 2015, President Obama signed the Consolidated Appropriations Act, 2016, an omnibus funding measure that provides $936 million to the Air Force GPS program in FY 2016. The President's request was $938 million (View source, 9 MB PDF)

Starting in FY 2016, GPS and other space programs received funding through a new Space Procurement budget account instead of via Missile Procurement. In another change, the FY 2016 budget includes no advance procurement funds for GPS III.

The joint explanatory statement includes the following note regarding its cut to GPS IIF procurement: "Unjustified support growth". This echoes the language in the House report. See table for sources.

Rescission

The act rescinds (takes back) $30 million in FY 2015 funds previously appropriated for GPS III advance procurement. Both the House and Senate recommended the rescission.

Reporting Requirement

The joint explanatory statement includes the following direction:

In light of significant delays to the Global Positioning System (GPS) III Operational Control Segment, the Air Force plan to accelerate GPS III satellite launches would put approximately fourteen satellites on orbit before the ground system is available to operate and integrate the satellites into the positioning, timing, and navigation architecture. Therefore, the Constellation Sustainment Assessment Team is directed to conduct a review, with validation by the Commander of the United States Strategic Command, to determine if the current GPS III satellite launch plan should be adjusted to ensure necessary operational testing on early vehicles has been completed and potential satellite deficiencies have been discovered before more satellites are launched. This review should be provided to the congressional defense committees not later than 60 days after the enactment of this Act. View source (23 MB)

Program Guidance

The Senate report earmarks $80 million in GPS III development funds for "technology maturation efforts for a digital navigation payload and satellite vehicle development for the GPS III SV11+ production competition." View source (800 KB)

The Senate report "directs the Cost Assessment and Program Evaluation [CAPE] and Joint Requirements Oversight Council [JROC] to review the cost of and validate the requirements for accelerating GPS III launches ahead of the plan laid out in the fiscal year 2015 budget submission." Transportation Appropriations

On December 18, 2015, President Obama signed the Consolidated Appropriations Act, 2016, an omnibus funding measure that provides the Department of Transportation with funds to support designated civil elements of the Air Force GPS program in FY 2016, along with civil GPS augmentations and related activities.

Reporting Requirements

Defense Authorization

On September 25, 2015, President Obama signed the National Defense Authorization Act for Fiscal Year 2016. The act includes policy and funding guidance for the GPS program. It does not expend funds from the U.S. Treasury.

The final act explains its cut to GPS IIF with this note: "Unjustified support growth". Earlier, the Senate proposed cutting GPS III procurement with this note: "GPS III SV10 early to need". See table above for sources.

Reporting Requirement

Section 1621 states, "Not later than 90 days after the date of the enactment of this Act, and every 90 days thereafter, the Secretary of the Air Force shall submit to the Comptroller General of the United States a report and supporting documentation on the Global Positioning System III space segment, the Global Positioning System operational control segment, and the Military Global Positioning System user equipment acquisition programs."

Oversight Council

Section 1603 establishes a Council on Oversight of the Department of Defense Positioning, Navigation, and Timing Enterprise that "shall be responsible for oversight of the Department of Defense positioning, navigation, and timing enterprise, including positioning, navigation, and timing services provided to civil, commercial, scientific, and international users."

M-Code Equipage

Section 1605 amends Section 913 of the Ike Skelton National Defense Authorization Act for Fiscal Year 2011, which requires all GPS user equipment purchased by DOD after FY 2017 to be M-Code capable unless excepted by law or waived by the Secretary of Defense. The amendment states that, "The Secretary of Defense may not delegate the authority to make a waiver under subsection (c) to an official below the level of the Secretaries of the military departments or the Under Secretary of Defense for Acquisition, Technology, and Logistics."

Program Guidance

The House report on H.R. 1735 provides recommendations on GPS III, military user equipment, and OCX. Among other things, it "directs the Under Secretary of Defense for Acquisition, Technology, and Logistics to provide a briefing to the House Committee on Armed Services by October 1, 2015, on the potential value and feasibility of establishing a temporary independent advisory team for GPS OCX." National Positioning, Navigation, and Timing Resilience

The House report includes language regarding a backup system to GPS. It "directs the Secretary of Defense to provide a briefing to the House Committee on Armed Services by January 15, 2016, on the Department of Defense requirements for backup position, navigation, and timing capabilities, including the plan and estimated cost to address such requirements."
